Terms and Conditions of Purchase

1. Scope

These Terms and Conditions ("Terms") govern the purchase of services offered by Queerify Ltd. ("Queerify"). These Terms apply to all certification programmes, training, and speaker bookings ("Services").

2. Acceptance of Terms

By placing an order for Services, you (the "Client") agree to be bound by these Terms.

3. Services

Queerify offers the following Services:

  • LGBTQ+ Safe Space Certification: A programme that helps businesses create inclusive environments for LGBTQ+ customers and employees.

  • Best LGBTQ+ Employers Certification: A recognition programme for organisations committed to LGBTQ+ inclusion within the workplace.

  • Diversity, Equity & Inclusion (DEI) Training Programmes: Educational workshops designed to equip organisations with the knowledge and skills to build an inclusive workplace.

  • LGBTQ+ Speaker Bookings: Access to a network of accomplished LGBTQ+ professionals for speaking engagements at your events.

4. Certification Renewal

Queerify certifications are not subscriptions. Clients will be contacted annually to determine their interest in renewing their certification.

5. Fees and Payment

  • Fees for Services will be quoted to the Client before purchase.

  • Payment for Services is due in full upon placement of the order.

  • Queerify accepts payment by bank transfer.

 

6. Cancellation Policy

  • Certifications: Cancellation of a certification order is only accepted within 7 days of purchase, provided the certification process has not yet begun. A full refund will be issued in such cases.

  • Training and Speaker Bookings: The cancellation policy typically follows this structure (unless agreed otherwise):

  • Cancellations more than 60 days before the event will be eligible for a 50% refund.

  • Cancellations within 30-60 days before the event will be eligible for a 25% refund.

  • Cancellations within 30 days of the event are not eligible for a refund. However, rescheduling might be offered for a 25% surcharge, subject to trainer or speaker availability.
     

7. Delivery and Performance

  • Delivery timelines for Training and Speaker Bookings will be communicated to the Client at the time of purchase. Timeline for the delivery of certifications can only approximate, as the delivery date will depend on both Queerify and the Client.

  • Queerify will use all reasonable efforts to perform Services in accordance with the agreed-upon scope.
     

8. Certification Process and Delivery

Queerify will conduct an assessment to determine if the Client meets the certification criteria. If the Client does not meet the certification criteria to a satisfactory extent, Queerify will provide a report outlining the areas for improvement.

Queerify will work collaboratively with the Client to develop a corrective action plan with specific actions and an agreed timeframe for implementation. Following the agreed timeframe, Queerify will reassess the Client's compliance with the certification criteria.

If the Client meets the certification criteria after implementing the corrective action plan, Queerify will grant the certification. In the unlikely event that the Client fails to meet the certification criteria to a satisfactory extent after implementing the corrective action plan, Queerify may refuse to grant the certification. However, all other services previously agreed upon as part of the "Certification Package" will still be delivered to the Client.
 

9. Intellectual Property

All intellectual property rights associated with the Services (including training materials, certification logos) belong to Queerify. Clients are granted a non-exclusive, limited licence to use the Services as outlined in their final certification report.
 

10. Confidentiality

Queerify will treat all Client information as confidential.
 

11. Disclaimer of Warranties

Queerify disclaims all warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Queerify does not warrant that the services will meet your specific needs or requirements.
 

12. Limitation of Liability

Queerify's liability to client for any cause whatsoever, and regardless of the form of the action, will be limited to the amount paid by client for the services. In no event will Queerify be liable for any indirect, special, incidental, or consequential damages (including lost profits) arising out of or related to the services, even if Queerify has been advised of the possibility of such damages.
 

13. Force Majeure

Queerify will not be liable for any delays or failures in performance due to causes beyond its reasonable control, including force majeure, war, terrorism, industrial disputes, government regulations, or delays or disruptions in transportation that prevent the presence of necessary personnel.
 

14. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of England and Wales. In the event of any dispute arising out of or in connection with these Terms, the parties shall attempt to resolve the dispute amicably through negotiations. If the parties are unable to resolve the dispute within 180 days, the dispute shall be referred to mediation in accordance with the CEDR Model Mediation Rules. The decision of the mediator shall be binding on the parties.
 

15. Entire Agreement

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
 

16. Amendment

Queerify reserves the right to amend these Terms at any time. The amended Terms will be effective upon posting on the Website.
